Terms of Service

Fees and Commissions: ​

There is no up-front service fee. Buckley Estate Sales charges a flat 15% commission fee from the Client. This is the most affordable commission rate in New Hampshire, and we are fully willing to price-match any company doing it for less. 

 

The Client agrees to half of the 5.3% payment processing fees associated with the auction. This equates to 2.65% of every sale. This will be deducted automatically from the final payout. (15% + 2.65% = 17.65%)

The Client agrees to a $75.00 ad fee. For multi-consignor auctions, the ad fee will be split among the consignors, proportional to your number of items in the auction.

In total, The Client will owe 17.65% of the hammer price + $75.00 ad fee* after the auction, to be automatically deducted from the Client's final payout.

​

Buyer's Premium: 

15% for single client auctions (estate sales, etc.)

18% for multi-consignor auctions.

 

What is buyer's premium?

 

Buyer's premium is an additional fee paid by the buyer of an item, automatically added to the final hammer price. This fee is collected and retained by Buckley Estate Sales. This fee, along with commission, can be negotiated in the case of single item or high-value sales, such as vehicles.

Taxes & Reporting:

We act solely as an agent in the sale of client-owned property. Sale proceeds paid to clients represent the return of funds from the sale of their property and are not payments for services. Clients are solely responsible for determining and reporting any tax obligations arising from their sales. We do not provide tax advice.

Ownership:

The Client must have legal ownership of all items for sale. 

 

Finality of Sales:

All sales are final. Sellers cannot demand the return of items once sold. The sale of items that sell for less than expected cannot be cancelled. If you are emotionally attached to an item, don't sell it. Items can be retracted from the auction within 24 hours of the auction listing.

Item Retraction:

Seller may request to retract an item from the auction only within 24 hours of the auction listing, for any reason.

Auction Duration:

Items will be listed for a specified duration, as agreed upon between Buckley Estate Sales and the seller. Auctions listed for two weeks or longer provides ample time to get eyes on your items. Shorter auctions often have less bidders as a result of inefficient ad time.

 

Reserve Price:

No reserves. Starting bids are allowed, though many bidders tend to avoid these listings.

Pick-up Dates:

Items will be picked up on a specified date(s) and time, as agreed upon between Buckley Estate Sales and the seller. This date must be chosen before the auction listing. The seller agrees to be available at this time and/or give Buckley Estate Sales access to your estate.

 

Limitation of Liability:

No guarantees regarding the sale price or the successful sale of any item. We are not a cleaning or clear out service, and are not responsible for any unsold items within the home.

Indemnification: 

Clients and buyers agree to indemnify and hold Buckley Estate Sales harmless from any claims, damages, or expenses that arise from using our service.

Privacy and Confidentiality:

Buckley Estate Sales takes the privacy and confidentiality of its clients and buyers seriously. Any and all personal information, including payment details, is processed through the trusted third-party platforms Authorize.net, WorldPay, and AuctionNinja. The clients address will only be shared with winning bidders for the purpose of arranging item pick-up.​

Shipping: 

Shipping will be available for small items. This attracts more bidders, and will significantly increase the total value of the auction. Additional time must be provided in house to package the items sold for shipping. Buckley Estate Sales will be solely responsible for the labor, with no additional fees to the Client. The buyer pays all shipping, handling, and material fees.

By using Buckley Estate Sale's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. The client will be required to sign this document in contract form.
